AI Content Policy & EU Transparency Notice

This AI Content Policy & EU Transparency Notice ("AI Content Policy") governs the use of artificial intelligence features made available through song.so, including features that generate, modify, transform or otherwise process images, videos, text or other content.
This AI Content Policy forms part of the song.so Terms of Service. By accessing or using any AI-powered feature of song.so, you agree to this AI Content Policy.
For users located in, established in, or making AI-generated content available within the European Union, this Policy also contains important information regarding transparency and disclosure obligations under Regulation (EU) 2024/1689, commonly referred to as the EU Artificial Intelligence Act ("EU AI Act").
1. AI Features and Third-Party Providers
song.so provides tools that allow users to create, modify, transcribe, analyse, transform and otherwise process content using artificial intelligence and related technologies ("AI Features").
To provide these features, song.so may use third-party artificial intelligence, processing and infrastructure providers, including xAI, Kie AI, rendi.dev and AssemblyAI.
Depending on the feature you use, Input submitted by you — including audio, images, videos, text, prompts and other files — may be transmitted to and processed by one or more of these providers in order to perform the requested functionality.
The specific provider used may vary depending on the selected feature, AI model, content type, technical availability and processing requirements.
The fact that an AI system or third-party provider technically accepts particular Input or is capable of generating or processing particular Output does not mean that the Input, processing, generation or subsequent use of the Output is lawful.
song.so does not provide copyright clearance, trademark clearance, personality-right clearance, privacy clearance or any other rights clearance for Input or Output.
You remain responsible for ensuring that you have all rights, licenses, permissions, consents and legal bases required to submit content for processing through song.so and its third-party service providers.
2. Definitions
For the purposes of this AI Content Policy:
- "Input" means any prompt, image, photograph, video, audio file, artwork, logo, trademark, text, file, data, reference material, person, likeness or other content that you upload, submit, reference or otherwise provide in connection with an AI Feature.
- "Output" means any image, video, text, audio or other material generated, modified or otherwise produced by an AI Feature based wholly or partly on your Input.
- "AI Content" means Output generated or manipulated using an AI Feature.
- "Third-Party Rights" include, without limitation: copyright and related rights; trademark and design rights; rights in photographs and audiovisual works; personality and publicity rights; rights to a person's name, image, likeness or voice; privacy and data-protection rights; contractual rights; confidentiality rights; and any other intellectual-property or proprietary rights.
3. You Are Responsible for Your Input
You are solely responsible for all Input that you submit to song.so and its AI Features.
By submitting Input, you represent and warrant that:
- you own the Input or have obtained all rights necessary to use it;
- you have all necessary licenses, permissions, authorisations and consents required to submit and process the Input using an artificial intelligence service;
- you have the right to allow the Input to be analysed, transformed, modified or otherwise processed by song.so and its third-party AI providers;
- your Input does not infringe, misappropriate or otherwise violate any Third-Party Rights;
- your Input complies with applicable laws and regulations; and
- where your intended use of the resulting Output is commercial, you have obtained all rights and permissions necessary for such commercial use.
These representations and warranties apply on an ongoing basis every time you use an AI Feature.
4. Copyrighted and Third-Party Content
You must not upload or submit copyrighted or otherwise protected content unless:
- you own the applicable rights;
- the applicable rights have been validly licensed to you; or
- you have otherwise obtained explicit permission allowing the intended AI processing and subsequent use.
This includes, without limitation:
- photographs;
- artwork;
- illustrations;
- music artwork and album covers;
- music videos;
- film and television material;
- advertisements;
- logos;
- brand assets;
- characters;
- graphic designs;
- visual identities;
- photographs of third parties;
- celebrity imagery; and
- other protected creative works.
The fact that content is publicly accessible online does not mean that it is free to use.
Likewise, the fact that content can be downloaded, screenshotted, copied or uploaded to song.so does not mean that you have the legal right to use it.
5. Images, Likenesses and Voices of Other People
You are responsible for ensuring that you have the necessary legal basis, consent or other rights before uploading or using photographs, videos, voices, likenesses or other identifying characteristics of another individual.
This is particularly important where AI is used to:
- alter a person's appearance;
- replace a person's face;
- imitate a person's voice;
- create a realistic depiction of a person;
- depict a person performing an action they did not perform;
- place a person in a fictional environment;
- generate advertising materials featuring that person; or
- otherwise create synthetic or manipulated representations of real individuals.
Different jurisdictions may provide individuals with rights relating to their image, likeness, voice, privacy, personal data or commercial identity.
You are solely responsible for ensuring that your use complies with those laws.
6. Responsibility for AI-Generated Output
You are solely responsible for reviewing and evaluating Output before using, publishing, distributing or commercialising it.
AI-generated Output may:
- contain inaccuracies;
- contain unexpected elements;
- resemble existing works;
- resemble existing brands or designs;
- resemble real individuals;
- contain copyrighted or trademarked elements;
- be similar or identical to Output generated for another user;
- not qualify for copyright protection;
- contain material that is inappropriate for your intended purpose; or
- otherwise affect third-party rights.
Accordingly, song.so does not represent or warrant that any Output is:
- unique;
- original;
- copyrightable;
- free from Third-Party Rights;
- non-infringing;
- commercially exploitable;
- suitable for advertising;
- suitable for publication; or
- legally permissible for your intended use.
You must independently determine whether Output is appropriate and lawful for your intended use.
7. Commercial Use
AI-generated Output may be used commercially only where such use is permitted under applicable law, this AI Content Policy, the song.so Terms of Service and any applicable third-party terms.
The technical ability to export or download AI Content from song.so does not constitute a representation by song.so that the content is legally cleared for commercial use.
Before using Output commercially, you are responsible for assessing whether additional rights or permissions are required.
This includes use in:
- advertising campaigns;
- social media advertising;
- album and single artwork;
- music videos;
- merchandise;
- websites;
- brand campaigns;
- paid media;
- promotional materials;
- television;
- film;
- events;
- ticketing;
- publications; and
- other commercial communications.
8. EU Artificial Intelligence Act
8.1 General
For users in the European Union, certain uses of AI-generated or AI-manipulated content may be subject to transparency obligations under Article 50 of Regulation (EU) 2024/1689 (EU AI Act).
These transparency obligations apply from August 2, 2026, subject to specific transitional provisions under the EU AI Act.
The precise legal obligations that apply depend on, among other things:
- the type of AI system;
- the type of content;
- whether the content is AI-generated or AI-manipulated;
- whether the content qualifies as a deepfake;
- how the content is used;
- where the content is published;
- whether the user acts professionally or commercially;
- whether the content is artistic, creative, satirical or fictional; and
- whether another exception under applicable law applies.
song.so cannot determine these circumstances on your behalf.
You remain responsible for determining which transparency obligations apply to your use of AI Content.
9. Deepfakes under the EU AI Act
The EU AI Act provides specific transparency rules for certain AI-generated or manipulated image, audio and video content commonly referred to as deepfakes.
Broadly speaking, a deepfake may include AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and could falsely appear to a person to be authentic or truthful.
Examples may include:
- an AI-generated photograph that appears to show a real person doing something that did not occur;
- an AI-generated video of a real artist performing or speaking;
- a face swap involving a real individual;
- synthetic footage appearing to depict a real event;
- realistic AI-generated footage of a real location or object presented as authentic footage; or
- manipulated material that materially changes what appears to have occurred.
Whether particular content legally qualifies as a deepfake must be assessed based on the circumstances of the individual case.
10. Your Disclosure Obligations in the European Union
Where Article 50 or another provision of the EU AI Act requires disclosure, you are responsible for ensuring that the persons exposed to the content are clearly informed that the relevant content has been artificially generated or manipulated.
A disclosure must be made in accordance with the requirements applicable to the relevant content and use case.
Machine-readable AI metadata or provenance information alone may not necessarily satisfy a visible disclosure obligation applicable to a deployer of an AI system.
In particular, professional and commercial users should carefully assess whether AI-generated or manipulated content they publish qualifies for disclosure under Article 50 of the EU AI Act.
11. EU AI Content Icon Provided by song.so
To assist users with transparency and disclosure, song.so may provide an AI Content Icon based on or corresponding to the icon system published by the European Commission and the EU AI Office.
The EU icons are designed to facilitate consistent communication that content has been generated or manipulated using artificial intelligence.
Where available, song.so may allow you to add such an icon when exporting AI Content.
song.so strongly recommends retaining and using the AI Content Icon where an AI disclosure is legally required or otherwise appropriate.
Depending on the content, song.so may also recommend using accompanying language such as:
- "AI-generated"
- "Generated with AI"
- or
- "AI-manipulated"
- as appropriate.
12. The EU Icon Is a Compliance Tool, Not a Legal Determination
The availability of the EU AI Content Icon within song.so is provided solely as a technical compliance assistance feature.
Its availability does not mean that:
- the icon is legally required in every case;
- the icon alone is sufficient in every case;
- using the icon automatically makes your publication compliant with the EU AI Act;
- no additional disclosure is required;
- the Output is legally safe to publish; or
- song.so has assessed your individual legal obligations.
The European Commission's icon system is intended to assist with AI transparency.
It does not replace your own responsibility to determine and satisfy your applicable disclosure obligations.
13. Removal of the AI Content Icon
Depending on the functionality available at the time of export and the manner in which you subsequently edit the exported content, it may be technically possible for you to remove, crop, cover, obscure, alter or otherwise eliminate an AI Content Icon provided by song.so.
Where you do so, you are solely responsible for determining whether publication or distribution of the resulting content remains compliant with applicable law.
If you remove, disable, crop, cover, obscure or otherwise interfere with a disclosure provided by song.so and subsequently publish or distribute the content without a legally required disclosure, that decision and the resulting publication are within your responsibility.
To the fullest extent permitted by applicable law, song.so is not responsible or liable for claims, penalties, damages or other consequences arising from:
- your removal of an AI disclosure;
- your alteration of an AI disclosure;
- your failure to use an available AI disclosure;
- your failure to provide an alternative legally sufficient disclosure; or
- your publication or distribution of AI Content without a disclosure required by applicable law.
Nothing in this section excludes or limits any statutory obligation that applies directly to song.so and cannot legally be excluded or transferred.
14. Exporting AI Content
When exporting AI Content from song.so, you should consider whether the content requires an AI disclosure.
Where song.so provides an AI Content Icon or other disclosure feature, we strongly recommend that you retain it whenever there is uncertainty as to whether disclosure is required.
Removing a label or icon from an exported file does not remove any legal obligation that may apply to your subsequent use of that file.
You are responsible for ensuring that any legally required disclosure remains visible, understandable and appropriately presented when content is:
- downloaded;
- edited;
- cropped;
- reformatted;
- reposted;
- shared;
- embedded;
- uploaded to another platform;
- used in advertising; or
- otherwise distributed.
15. Placement and Visibility
Where a visible AI disclosure is required, users should ensure that the disclosure is clear and distinguishable when a person is first exposed to the relevant content.
Depending on the medium, this may require that the disclosure:
- is clearly visible;
- is not hidden by another interface element;
- is displayed at an appropriate size;
- remains reasonably perceivable after reposting or sharing;
- is displayed long enough to be understood where shown temporarily; and
- is presented in a manner appropriate for the relevant image or video.
The appropriate implementation may differ depending on the content and platform.
16. Artistic, Creative, Satirical and Fictional Content
The EU AI Act contains special considerations for deepfake content forming part of evidently artistic, creative, satirical, fictional or analogous works or programmes.
Such content is not necessarily completely exempt from transparency requirements.
Rather, where the relevant provisions apply, disclosure may be made in an appropriate manner that does not hamper the display or enjoyment of the work.
Users remain responsible for determining whether this regime applies to their particular use.
17. Personal vs. Professional Use in the EU
Certain obligations under the EU AI Act distinguish between personal, non-professional activities and the professional use of AI systems.
An individual using AI solely in a personal and non-professional context may be treated differently from a business, artist, creator, agency, label, advertiser, freelancer or other professional user.
If you use song.so in connection with:
- a business;
- your profession;
- your work as a creator;
- monetised social media activity;
- advertising;
- music promotion;
- an artist project;
- a brand;
- paid content;
- commercial distribution; or
- other economic activities,
you should not assume that a personal-use exception applies.
18. Platform-Specific Requirements
Third-party platforms may impose AI-content disclosure requirements that are broader than those required by law.
Examples include social networks, advertising networks, streaming services, marketplaces and content platforms.
You are responsible for complying with the rules of any platform on which you publish AI Content.
A disclosure that satisfies song.so's technical export options does not guarantee compliance with the rules of:
- Instagram;
- Facebook;
- TikTok;
- YouTube;
- X;
- Spotify;
- Google;
- advertising networks; or
- any other third-party service.
19. Machine-Readable AI Markings
AI-generated or manipulated content may contain machine-readable information, metadata, provenance information, watermarks, credentials or other technical indicators intended to identify AI-generated or manipulated content.
Such measures may be provided by song.so, an underlying AI provider or another technology provider.
You must not intentionally remove, disable or interfere with machine-readable AI markings where doing so would violate applicable law, these Terms or applicable third-party terms.
The presence of a machine-readable marking does not necessarily remove the need for a visible disclosure where such visible disclosure is required by law.
20. Third-Party AI Terms
Certain AI Features rely on third-party providers, including xAI, Kie AI, rendi.dev and AssemblyAI.
Your use of those features may therefore also be subject to limitations derived from the applicable third-party provider's terms, acceptable-use policies and technical rules.
You may not use song.so to circumvent restrictions imposed by an underlying AI provider.
song.so may:
- reject particular Inputs;
- refuse particular generation requests;
- block particular Output;
- impose technical restrictions;
- suspend access to AI Features; or
- terminate access in cases of suspected abuse or violations.
The fact that one generation request succeeds does not mean that similar use is permitted in the future.
21. No Guarantee of Copyright Protection
AI-generated Output may not qualify for copyright or equivalent intellectual-property protection in every jurisdiction.
The legal treatment of AI-generated works continues to develop and may depend on factors including:
- the jurisdiction;
- the level of human creative contribution;
- the nature of the Input;
- the generation process; and
- subsequent human modification.
song.so makes no representation regarding whether copyright or other exclusive rights exist in any particular Output.
You are responsible for determining the protection available to your Output.
22. No Guarantee of Non-Infringement
Even where you own or are permitted to use Output as between you and the applicable AI service provider, this does not mean that the Output cannot affect rights held by someone else.
Ownership of Output and freedom from third-party rights are separate legal questions.
Accordingly, song.so does not warrant that Output does not infringe:
- copyrights;
- trademarks;
- designs;
- personality rights;
- publicity rights;
- privacy rights; or
- other Third-Party Rights.
23. User Responsibility
You are solely responsible for:
- your Input;
- the instructions and prompts you provide;
- ensuring that you have the rights necessary to submit your Input;
- reviewing generated Output;
- deciding whether Output may legally be used;
- obtaining additional licenses or consents where required;
- complying with disclosure and transparency obligations;
- deciding whether and how to use song.so's AI Content Icon;
- retaining any legally required disclosures;
- complying with the EU AI Act where applicable;
- complying with intellectual-property law;
- complying with privacy and personality-right laws;
- complying with advertising law;
- complying with applicable platform policies; and
- the publication, distribution, commercialisation and other use of Output.
24. No Legal Advice or Rights Clearance
song.so provides software tools.
song.so does not provide legal advice.
Information, warnings, labels, icons, documentation, recommendations or compliance features provided through song.so are intended to assist users but do not constitute legal advice or an individual legal assessment.
If you are uncertain whether particular Input or Output may legally be used, you should obtain appropriate professional advice before publication or commercial use.
25. Liability for User Content and Use of Output
To the fullest extent permitted by applicable law, song.so shall not be liable for claims, losses, damages, penalties, costs or disputes arising out of or relating to:
- Input submitted by you;
- your lack of rights in Input;
- AI-generated Output;
- your use of Output;
- alleged infringement of Third-Party Rights;
- your publication of AI-generated or manipulated content;
- your failure to disclose AI involvement;
- your removal or modification of AI labels;
- your violation of the EU AI Act;
- your violation of third-party platform requirements; or
- your violation of applicable law.
Nothing in this Policy excludes or limits liability that cannot lawfully be excluded or limited.
26. Indemnification for Business Users
If you use song.so in connection with a business, trade, profession or other commercial activity, you agree, to the fullest extent permitted by applicable law, to indemnify, defend and hold harmless song.so, its operator, affiliates, officers, employees, contractors and service providers from and against third-party claims, liabilities, damages, losses, penalties, costs and reasonable legal expenses arising from or relating to:
- your Input;
- your violation of Third-Party Rights;
- your use or publication of Output;
- your failure to obtain required rights or consents;
- your failure to comply with AI disclosure obligations;
- your removal or alteration of AI disclosures;
- your breach of this AI Content Policy; or
- your violation of applicable law.
This provision applies only to the extent permitted by applicable law.
27. Suspension and Enforcement
song.so may suspend, restrict or terminate access to AI Features where we reasonably believe that a user:
- repeatedly infringes third-party rights;
- uploads material without necessary rights;
- abuses the AI Features;
- uses AI Features unlawfully;
- attempts to circumvent safeguards;
- impersonates individuals unlawfully;
- violates applicable AI transparency obligations in connection with the Service;
- violates applicable third-party AI provider policies; or
- otherwise materially breaches this AI Content Policy.
song.so may also remove or restrict AI Features where required by an underlying AI provider or applicable law.
28. Changes to AI Regulation and This Policy
Artificial intelligence regulation, guidance, technical standards and industry practices continue to develop.
song.so may update:
- this AI Content Policy;
- AI disclosure functionality;
- the AI Content Icon;
- machine-readable markings;
- export functionality;
- warnings;
- compliance features; and
- other AI-related functionality
where reasonably necessary to reflect changes in applicable law, regulatory guidance, technical standards, underlying AI providers or industry practice.
Users remain responsible for complying with applicable law in effect at the time they publish or use AI Content.
29. Key User Acknowledgement
By using song.so's AI Features, you acknowledge and agree that:
- You are responsible for having all necessary rights, licenses and permissions for any content you submit to the AI Features.
- You are responsible for reviewing and legally using all AI-generated or AI-manipulated Output, including commercial use.
- song.so does not guarantee that AI-generated Output is unique, copyrightable or free from copyrights, trademarks, personality rights or other third-party rights.
- Where applicable law requires AI-generated or manipulated content to be disclosed, you are responsible for ensuring that the required disclosure is made when you publish or distribute the content.
- song.so may provide an EU-recommended AI Content Icon to facilitate such disclosure. The availability or use of that icon does not by itself establish legal compliance.
- If you remove, alter, crop, hide or otherwise omit an AI disclosure provided by song.so, you remain solely responsible for ensuring that your subsequent use and publication of the content complies with applicable law.
